[글로벌뷰] 검찰에 쫓기던 美 대통령들과 조국의 공통점

워싱턴 = 한국의 법무장관으로 조국을 임명한 것에 대한 소문은 도널드 트럼프 대통령의 법무장관 선택에 대한 워싱턴의 화제 중 하나를 상기시킨다. 그는 자신의 요구를 실현해 줄 수 있는 사람을 확실히 원하고, 그 사람의 이념적 견해가 확실하기를 원한다.

트럼프의 첫 번째 법무장관인 제프 세션스는 공화당 상원의원이다. 그는 트럼프의 캠페인 슬로건 “미국을 다시 위대하게”라는 문구가 박힌 모자를 썼다. 아마도 트럼프에게는 이상적인 선택이었을 것이다. 그는 불법 이민에 대한 트럼프의 견해를 지지했으며 범죄, 불법 약물 등에 대한 강력한 조치에 찬성했다. 그래서 무엇이 잘못되었다는 건가?

이에 대한 해답은 2016년 대선 당시 러시아의 개입 시도에 대한 조사에서 트럼프를 구해낸 세션스가 청렴하다는 것이었다. 그는 자신이 공화당과의 긴밀한 유대 관계를 고려할 때 개인적으로 조사를 책임질 수 없다고 결정했으며, 의심할 여지없이 청렴한 사람인 전 FBI 국장 인 로버트 뮬러를 특별검사로 지명했고, 그 결과 질질 끈 오랜 조사로 트럼프 진영의 측근들을 덫에 걸리게 했고 청렴성에 의문을 갖게 만들었다.

조사 과정에서 트럼프는 세션을 임명한 것에 후회한다고 말하면서 세션스를 여러 차례 퇴진 시키고 싶어 했다. 하지만 그렇게 충고하는 공화당 대표자들의 조언에 대해서는 신중했다. 조사가 끝난 후 뮬러는 자신의 결백을 주장하는 트럼프를 소추할 만한 증거가 없다고 말했지만 결과는 오히려 트럼프의 변호를 맡은 법무장관의 무기력함을 초래했다.

트럼프로서는 워싱턴에서 매우 오랜 기간을 보수로 지내온 세션스의 후임자 윌리엄 바가 훨씬 더 반갑다. 그는 대통령의 모든 권력과 명성을 손상시킬 수 있는 조사를 차단하면서 대통령을 지지했다. 그는 민주당이 통제하는 하원에 의해 트럼프 탄핵의 근거를 제공할 수 있는 투쟁 노력들과 유죄 판결을 받은 사람들에 대해 더 엄격한 처벌을 요구해 왔다.
 

검찰이 명령자를 수사할 때 벌어지는 일들

세션스나 바를 조국과 비교하는 것은 불공평할 것이다. 그들은 조국과 그의 아내 그리고 다른 친척들과 친구들처럼 검찰 수사 대상이 된 적이 없다. 그러나 이 사건은 범죄 기소 책임자와 이를 임명한 지도자 사이의 관계를 보여준다는 점에서 비교할 만하다.

조국의 경우 그는 법무장관이 책임을 지는 검찰 시스템을 개혁하기 위해 노력하고 있다. 의심할 여지없이 그는 자신과 자신의 가족을 쫓아다니는 검사를 버리면서 검찰 개혁을 시작하고 싶어 할 것이다. 하지만 쉽지 않은 일이다. 그런 것은 다른 미국의 대통령들이 자신의 죄를 방어하려 했던 것보다 그리고 트럼프가 세션스를 버리는 것보다 어려운 일이다.

대통령과 달리 법무장관으로서 가장 악명 높은(?) 사건은 1970년대 ‘워터게이트 사건’ 수사에서 일어났다. 당시 공화당 요원들은 워터게이트 단지에 있는 민주당 전국위원회 본부에 침입해 공화당과 닉슨을 도울 수 있는 자료를 찾고 있었다. 그러다가 경비원에게 붙잡혔다. 닉슨의 재임 기간이었다.

닉슨의 법무장관 엘리엇 리처드슨 그리고 차관인 윌리엄 러클스하우스는 닉슨의 대통령직을 둘러싼 모든 범죄, 특히 워터게이트 침입을 조사하는 특별검사를 해임하라는 닉슨 대통령 의 명령을 무시했다. 닉슨은 “저는 사기꾼이 아닙니다”라고 말했다. 아마도 하원이 탄핵에 투표하기 전에 닉슨이 했던 가장 기억에 남는 한마디였던 것 같다. 닉슨은 자신이 범죄자로 기소된 것을 보고 사임했다. 그후 부통령이었던 후임 제럴드 포드가 그를 사면했다.

빌 클린턴 역시 화려했다. 다시 한 번 특별검사가 임명됐다. 케네스 스타였다. 스타는 오벌 오피스에서 클린턴에게 구강 성교를 제공한 백악관 인턴 모니카 르윈스키를 조사했다. 클린턴은 “나는 그 여자와 섹스를 하지 않았다”고 말했다. 하원은 여전히 그를 탄핵했지만 상원은 그를 보호했다.

이 사건들은 조국의 사건과는 상당히 다른 경우다. 그러나 때로 범죄 기소의 책임자를 둘러싼 논쟁의 유형을 보여준다. 모든 국가 지도자들은 대변인을 통해 그를 지지해 줄 법무장관이나 변호사를 원한다.

조국 역시 분명히 그런 상황에 놓인 법무장관이지만 그의 감독 아래에 놓인 검찰이 조국 장관 자신과 그의 가족을 쫓는 한 오래 버티지 못할 수도 있다. 자신의 상황과 비교해 보는 차원에서 조국은 검찰이 어떻게 닉슨과 클린턴을 추격했는지 기억하고 싶을 수도 있다.

WASHINGTON = The furor surrounding the appointment of Cho Kuk as South Korea’s justice minister reminds one of the firestorms in Washington over President Donald Trump’s choices for attorney-general. He definitely wants a person whom he can rely to do his bidding, and he wants to be sure of the person’s ideological outlook.

Trump’s first attorney-general, Jeff Sessions, a Republican senator who donned a hat bearing Trump’s campaign slogan, “Make America Great Again,” would have appeared to have been the ideal choice. He supported Trump’s views on illegal immigration and was all in favor of tough measures against crime, illegal drugs and much else. So what could have gone wrong?

The answer was that Sessions had the integrity to recuse himself from an investigation into Russia’s attempts at interference in the 2016 presidential election. He decided that he personally could not take charge of the investigation considering his close ties to the Republican Party, and he appointed a man of undoubted integrity, Robert Mueller, former FBI director, to take charge of what turned into a protracted probe that ensnared some of Trump’s closest allies and raised questions about his basic integrity.

During the course of the investigation Trump repeatedly denigrated Sessions, saying he regretted having appointed him. He would have liked to have gotten rid of him but refrained from doing so on the advice of leading members of his own Republican Party. Mueller after the investigation was done said that he did not have the evidence needed to bring against Trump, who tried to say he was cleared, but the result was to weaken the strength of the attorney-general, in charge of the Department of Justice.

Trump is much happier with Sessions’ successor, William Barr, a deeply conservative long-time figure in Washington who has supported the president on everything while blocking investigations that might undermine his power and prestige. Barr has long called for tougher penalties for those convicted of crimes and battled efforts that might provide the basis for Trump’s impeachment by the Democrat-controlle d lower house, that is the House of Representatives.

It would probably not be fair to compare either Sessions or Barr with Cho Kuk. They themselves have never been the target of investigations such as that against Cho, his wife and other relatives and confidantes. The cases are comparable, however, in the sense that they show the relationships between the person responsible for prosecuting crimes and the leader who appointed them.

In the case of Cho Kuk, he is committed to revising the prosecutorial system for which ultimately the justice minister is responsible. No doubt he would love to begin by throwing out the prosecutor who has been going after him and his family. That will not be easy, however, any more than it was easy for Trump to dump Sessions and for other American presidents to fend off those pursuing them for their sins.

The most notorious instance of attorney-generals differing with their president occurred in the early 1970s during the investigation of “the Watergate scandal” in which Republican Party operatives were being investigated for breaking into the Democratic National Committee headquarters in the Watergate complex in Washington. They were looking for material that might aid the Republic Party and Richard Nixon, then in his second term as president, but were caught by a watchman.

Nixon’s attorney-general, Elliot Richardson, and Deputy Attorney-General William Ruckelshaus defied Nixon’s order for them to dismiss the special investigator looking into all the crimes surrounding his presidency, notably the Watergate break-in. “I’m not a crook,” was perhaps the most memorable line uttered by Nixon before the lower house had a chance to vote on his impeachment. Seeing he might be charged as a criminal, he resigned and was then pardoned by his successor Gerald Ford, who had been vice president.

The presidency of Bill Clinton was no less colorful. Again, a special prosecutor, Kenneth Starr, was appointed. Starr targeted the White House intern, Monica Lewinsky, who had been providing oral sex for Clinton in the oval office. “I did not have sex with that woman,” Clinton declared. The lower house still impeached him, but the upper house, the Senate, acquitted him.

If these cases are quite different from that of Cho Kuk, they show the type of controversy that sometimes surrounds the person in charge of prosecuting crime. Every national leader wants a justice minister, or attorney-general, who will support him through bitter controversy.

Cho is definitely that kind of minister, but he may not last long as a prosecutor below him goes after him and his family. For comparison's sake, he might want to remember how special prosecutors pursued Nixon and Clinton.
