고위관리나 평범한 시민들의 말하고 싶지 않은 비밀을 찾다보면 흥미로운 폭로와 스캔들이 종종 발생한다. 정부에 반대 입장인 사람들은 조사 대상자 뿐 아니라 고위급의 동조자들까지 난처하게 하도록 알려지지 않은 내용을 밝혀내겠다는 생각으로 노력을 기울인다.

미국에서 고위직 내정자는 과거 행적에 대한 조사가 매우 철저해 일반인들의 눈을 벗어날 수 없다. 하지만 그들의 임명이 발표되기 오래 전부터 그들은 나중에 밝혀지면 정치적 소동을 야기할 수 있는 것을 없애기 위해 면밀한 조사를 받는다. 일반인들은 고위직 내정자의 정치관, 학창 시절에서부터 초기 직장생활 때까지의 이야기는 알고 있다. 하지만 이들의 실제 이야기는 오랜 기간 드러나지 않는다.

부시가 과거를 극복할 수 있었던 이유

우리는 조지 W. 부시가 2000년 미국 최고위직인 대통령에 출마했을 때 그에 대한 이야기를 들었다. 대중은 그가 예일대에서 성적이 형편없었고 한때 술주정뱅이였다는 것을 잘 알고 있다. 정치적 뿌리가 깊은 부유한 명문가의 자손인 그는 이렇게 알려진 과거사를 극복하는 데 문제가 없었다.

유권자들은 부시가 유명한 미국 복음전도자인 빌리 그래함 목사와의 대화에서 ‘하나님을 발견’하고 미국 감리교회에 다닌다는 고백에 감사해했다. 미국에서 가톨릭 다음으로 가장 큰 종교 교단인 남침례교인들은 부시를 하나님을 경외하는 보수주의자로 사랑했다.

부시의 러닝메이트인 리처드 체니의 기록 역시 흠투성이다. 그는 예일대학에서 낙제했고 음주운전으로 체포됐으며 와이오밍대학에서 공부하며 5번이나 징집연기를 받았다. 이런 기록들은 그가 연방 하원에 당선되고 아버지 부시 대통령 때 국방장관으로 활동하며 아들 조지 W. 부시의 러닝메이트로 선거에서 2번이나 승리하는 데 문제가 되지 않았다.

임명직 관리들의 발목을 잡는 과거 기록

과거 기록들은 임명직 관리들에게 더 문제가 된다. 빌 클린턴 대통령 재임 시절 그가 선택한 2명의 법무장관 내정자들은 합법적 비자 없이 미국에 들어왔거나 머물고 있는 불법 외국인 여성들을 고용했다는 것이 밝혀지면서 사퇴했다.

가장 유명한 사례는 여성 최초로 미국 법무장관에 내정됐던 조 베어드(Zoe Baird)다. 그녀와 그녀의 남편은 보모와 운전기사가 불법체류자라는 것을 알면서도 이들을 고용했다는 보도가 터져나오자 사퇴했다. 그들은 이 사람들의 사회보장세금도 지급하지 않았다.

이 사건은 ‘보모게이트(nannygate)’로 알려졌는데 이 표현은 ‘Watergate’에서 ‘gate’를 따서 만든 말이다. Watergate(워터게이트)는 워싱턴 DC에 있는 아파트 단지 이름으로 이곳에 있던 민주당전국위원회 사무실을 리처드 닉슨 대통령 요원들이 잠입해 이들의 활동을 도청하다 잡힌 사건이다. 이 사건으로 닉슨 대통령은 나중에 사임해야 했다.

문제는 그것으로 끝나지 않았다. 그가 뉴욕 연방판사인 킴바 우드를 법무장관 후보로 임명하려고 할 때 그녀 역시 불법 이민자였던 보모를 고용했다는 것이 드러났다. 차이점은 우드는 이른바 ‘불법체류자’로 불리는 사람들의 고용을 금지하는 법이 집행되기 전에 그녀를 고용했다는 것이었다. 우드 또한 보모의 사회보장세금을 잘 내지 않았다. 제2의 ‘nannygate’를 두려워한 나머지 우드의 임명은 철회됐다.

또 다른 경우는 조지 W. 부시가 전 뉴욕시 경찰국장인 버나드 케릭을 국토안보부 장관으로 임명하려고 했던 때다. 그 역시 과거 불법체류자를 보모로 고용했던 적이 있고 이를 계기로 사퇴해야 한다는 압박이 컸다. 그는 곧 사퇴했지만 그가 윤리규정 위반에 대한 조사를 받고 있었다는 것이 드러났다. 많은 부패를 이유로 그는 기소됐고 장기 구형을 받았다. 계속되는 조사를 통해 그의 한국 스캔들도 밝혀졌다. 주한미군으로 복무하면서 그는 한 한국 여성 사이에서 딸을 낳았는데 26년 동안 한 번도 그 딸을 본 적이 없었다.

한국보다 혹독한 외국의 과거 검증

이것들은 고위공직 내정자가 과거 활동으로 사임을 해야 했고 어떤 경우는 형사처벌까지 받았던 많은 경우 중 3가지에 불과하다. 미국 역사에서 그리고 지금도 이뤄지고 있는 이와 같은 스캔들의 수는 엄청나다. 클린턴이 연방판사로 임명한 한 사람은 미국 상원에서 그가 횡령과 뇌물로 유죄라는 것을 안 뒤인 2010년 사임했다. 조지 H. W. 부시가 임명했던 또 다른 판사는 여직원을 성적으로 희롱해서 투옥됐다.

미국에서 고위직 임명자 및 후보들은 사기, 뇌물, 마약 소지, 불법적 영향력 행사, 수많은 범죄와 비행으로 기소당했다. 어떤 경우 그 동기는 정치적인 것일 수 있지만 조사관들은 내정자들이 법을 준수했는지 확인하기 위해 배경을 철저히 조사할 필요가 있었다. 미국과 다른 서구 나라들은 한국보다 훨씬 고위 공직 후보들에 대해 조사가 혹독하다. 이 때문에 많은 사람들은 책잡힐 만한 부정행위들을 제거하고 있다.

U.S. Appointees Face Tough Scrutiny For Corruption, Conflicts, Violations

The search for skeletons in the closets of high officials or even ordinary citizens produces intriguing revelations and sometimes scandals. It's natural for foes of the government to see what they can find in hopes of discovering unknown details that might embarrass not only those under such close scrutiny but also their allies in high places.
Prospective appointees in the U.S. face incredible searches into their pasts, so intensive that very little escapes the public eye. Long before their appointments are announced, however, they have already had to undergo investigation to be sure there's nothing there that would create a political furor if revealed much later. Generally the public knows about the records of high-level appointees, their political viewpoints, their life stories from school days to early job experience. Sometimes, the real stories do not emerge for many years.
On the highest level, look of all we heard about George W. Bush as he was running for president in 2000. The public became fully aware that he had had a mediocre record as a student at Yale and that he had once been a heavy drinker. The scion of a wealthy family with deep political ties, he had no problem overcoming the well known story of his past.
Voters may have appreciated the fact that Bush professed to have "found God" in conversations with the celebrated American evangelist, Billy Graham, and joined the United Methodist Church. Southern Baptists, the largest American religious grouping after the Catholic Church, loved him as a God-fearing conservative.
The record of Richard Cheney, Bush's running mate, was equally flawed. He flunked out of Yale, was arrested for drunk driving and received five draft determents while studying at the University of Wyoming. This record did not keep him from getting elected to the U.S. Congress, from serving as defense secretary under George W. Bush's father, President George H.W. Bush, or from winning two elections for vice president as George W. Bush's running mate.
Scrutiny may be more difficult in the case of those who are under consideration for appointments. During the presidency of Bill Clinton two of his selections for attorney-general had to withdraw amid revelations that they had hired women to work for them who were illegal aliens, that is, had entered or remained in the United States without the proper visas.
The most notorious case was that of Zoe Baird. Her nomination to become the first woman ever chosen for the post of attorney-general was withdrawn amid reports that she and her husband had hired a nanny and a chauffeur for her child while knowing full well they were in the U.S. illegally. Moreover, they had neglected to pay social security taxes on behalf of these people. The case became known as "nannygate" the suffix "gate" derived from "Watergate." That word, of course, was the name of the apartment complex in Washington where operatives broke into the office of the Democratic National Committee in order to bug its activities on behalf of President Richard Nixon, later forced to resign.
Clinton's problems with female appointees and their nannies were not over. When he attempted to name Kimba Wood, a federal judge in New York, as attorney-general, it turned out that she too had a nanny who had been an illegal alien. The difference was that Wood had hired the woman before enactment of a law barring people from hiring so-called "illegals" and Wood had also been careful about paying her social security taxes. Amid fears of another "nannygate" Wood's nomination had to be withdrawn.
Another potential appointee, Bernard Kerik, a former New York City police commissioner, selected by President George W. Bush as secretary for homeland security, tried to use his employment of an illegal alien as a nanny as a pretext for withdrawing his nomination for the post. Soon after he withdrew, however, he was revealed to be already under investigation for ethics violations. Finally indicted on numerous counts of corruption, he received a lengthy prison term. Subsequent investigation revealed a compelling Korea connection. While serving in the U.S. army in Korea, he and a Korean woman had a daughter whom he did not see again for 26 years.
These were just three of numerous cases in which information about the background and activities of officials has forced them to resign and, on occasion, face criminal charges. There are innumerable such scandals going deep into American history and continuing to the present. A Clinton appointee as a federal judge had to resign in 2010 after the U.S. senate found him guilty of perjury and bribery. Another judge, appointed by President George H.W. Bush, was imprisoned for sexually harassing female employees.
Appointees and nominees for high posts in the U.S. have been charged over the years with fraud, bribery, possession of drugs, influence-peddling and numerous other crimes and misdemeanors. The motives in some cases may be political, but investigators need to keep digging into the backgrounds of appointees to make sure they abide by the law. The U.S. and other western countries may be harsher on potential office-holders than is Korea. Probably many more get away with misbehavior for which they are never caught.
