북한의 끔찍한 인권 침해를 문제삼아온 사람들은 북한 당국이 가장 예민하게 반응하는 것 중 하나에 가격을 가한 것이 틀림없다. 북한인권에 대한 UN 북한인권조사위원회(COI) 보고서를 두고 북한 당국이 쏟아내는 욕설과 격렬한 비판의 정도가 갈수록 심해지고 있기 때문이다.

UN COI에 열거된 북한의 인권 침해 범죄를 헤이그에 소재한 국제사법재판소(ICC)에 제소하자는 UN 총회 부속 위원회의 제안을 두고 북한 당국은 지금 공황 상태에 빠져 있다. UN 안전보장이사회(이하 안보리)에서 이에 대한 토론이 본격적으로 시작되면, 북한에서 나오는 이 시끄러운 소음은 최고조에 이를 것으로 보인다.

우리 모두가 알고 있듯이 유엔 안보리에서 북한을 국제사법재판소에 회부하기로 동의할 가능성은 매우 희박하다. 북한은 북한인권 케이스가 더 이상 진전되지 않도록 거부권을 행사할 수 있는 강력한 친구 둘을 유엔 안보리에 갖고 있기 때문이다.


중국과 러시아의 입장


그 중 하나는 중국이다. 북한의 유일한 동맹국인 중국은 북한에 원료 대부분과 식량 절반을 공급하고 있으므로, 북한이 국제사법재판소의 실제 ‘재판’에서 창피당하기를 원하지 않는다. 중국에 최우선 순위는 인권이나 복지가 아니라 ‘안정’이다.

다른 한 나라는 러시아인데, 블라디미르 푸틴 대통령은 현재 우크라이나 남부의 크림 지역을 탈취하고 있는 상태이다. 따라서 우크라이나 동부의 친 러시아 세력을 지원하는 자신의 확장주의 정책을 비판하는 것에 대해 화를 내고 있어, 북한을 정의에 심판대에 올려놓으려는 미국 등 서방의 노력에 대해 반대하는 입장을 취할 것으로 보인다.

러시아는 북한을 미국과 서방뿐만 아니라 중국과 겨루는 전장터로 보고 있다. 러시아는 또 북한과 국경을 접한 두만강을 따라 나선 경제특구 및 장차 한국까지 내려가는 경제지대를 건설한다는 계획을 추진하며, 천연가스 거래를 위해 북한에 다가서고 있는 입장이다.

 

북한의 인권 문제를 이슈로 삼는 이유

일부 비판가들이 묻는 질문은 왜 미국과 그의 동맹들이 북한인권 이슈를 문제삼느냐는 것이다. 그들은 이 정책은 긴장만 부채질할 뿐이라고 말한다.

극단적인 시각을 가진 사람들은 인권 이슈를 거론하면 북한이 궁지에 몰린 생쥐처럼 자신을 지키기 위해 핵무기로 싸우는 제2의 한국전쟁이 발발할 위험이 고조될 것이라고 말한다.

이런 말은 미 의회에서 이뤄지는 북한인권 문제에 대한 토론이나 한국 국회에서 지지부진하게 진행되고 있는 북한인권법안에 대한 토론에서도 나오고 있다.

이런 반대는 터무니없는 것이다. 미국과 한국이 이런 말도 안 되는 소리에 귀 기울인다면 이를 통해 배울 수 있는 교훈은 분명하다. 북한은 적들이 뒤로 물러서도록 겁을 주는 강화된 정치선전만 하면 되는 것이다.

요점은 이렇다. 미국과 한국은 북한의 속임수에 대해, 그런 말들은 소용이 없으며, 아무 효과도 없고, 그 어떤 것도 이루지 못할 것이라는 확고한 입장을 갖고 있다.

또 다른 요인이 이러한 논란 가운데 있다. 북한 정권 압제 하에서 고통당하는 수백만 북한 주민은 무엇인가? 최악의 정치범 수용소에서 갇혀 있는 수십만 북한 주민들이 견뎌야 하는 고문과 두려움은 어떻게 해야 하는가?

먹을 식량이 충분하지 않고 의약품과 생필품 없이 처참하기 이를 데 없는 가난 속에서 살아야 하는 수백만 북한 주민들은 무엇인가? 북한 지도자들이 자신의 비평가들을 통해 퍼뜨리려는 두려움에 우리는 겁먹고 움츠러든 채 이들을 잊어버려야 하는가?

이 토론들에서 가장 충격적인 것은 미국, 한국 등에서 일부 사람들은 받아들이지 말았어야 할 북한의 정치 선전을 수용하고 있다는 것이다. 이들 중 다수는 자신을 리버럴(liberal)이라고 말한다. 이들은 모든 곳의 가난한 사람들의 권리를 보호한다며 정부는 보수적이며 냉담하다고 비판하는 데 빠른 사람들이다.


북한의 희망사항과 국제사회의 의무

그들은 노동자의 권리, 노동자 들의 더 높은 임금 및 재벌의 힘을 제한하기 위해 싸운다면서 왜 북한 지도자들이 안락과 사치를 부리며 살고 있는 사이 굶어죽는 수준의 임금에 생계를 이어가는 대다수 북한 주민들에 대해서는 그렇게 둔감한가?

국제사회는 북한 주민들의 인권을 위해 싸울 신성한 의무를 갖고 있다. 좌파의 비판에도 불구하고 미국과 다른 서방 국가들은 북한을 재판에 회부하려고 하는 것 같다.

이 목적을 이룰 가능성은 거의 없지만 그들은 최소한 자신들이 믿는 것을 위해 싸워야 한다. 하지만 다른 가능성도 있다. 중국과 러시아가 북한을 국제사법재판소에 회부하는 것을 막은 후에, 미국과 다른 나라들은 북한인권운동에 지칠 것이고 결국 북한의 핵 프로그램을 합법화하는 핵 회담 재개를 고려할 수 있는 것이다.

미국이 주도하는 국제사회는 북한인권 침해 케이스가 국제사법재판소 회부되지 못하더라도 북한의 정치 선전이 완전히 실패하도록 해야 한다.

U.S., S. Korea Need to Stand Firm As N. Korea Intensifies Rhetoric Against Criminal Trial for Human Rights Abuses

Critics of North Korea's abominable human rights record have surely hit one of the North's most sensitive, rawest nerve endings. The torrent of invective and polemics emanating from the North concerning the report by the United Nations Commission of Inquiry on North Korean human rights is growing stronger by the day.

The reason is North Korean authorities are clearly in a state of panic over the prospect of the recommendations by a committee of the UN General Assembly to bring the North's crimes as enumerated by the Commission of Inquiry before the International Criminal Court in the Hague.

With a debate coming up in the UN Security Council, the noise of the rhetoric from Pyongyang is sure to hit fever pitch.

Of course, as we all know, the Security Council is extremely unlikely to agree to send the case to the International Criminal Court. The reason why that's not going to happen is the North has two powerful friends on the Security Council who are ready to exercise their power of veto to keep the case from moving forward.

Still, as North Korea's only ally and the source of most of its fuel and half its food, China does not want North Korea to suffer the humiliation of an actual "trial" before the ICC. For China, the priority remains "stability" not human rights or welfare.

As for Russia, President Vladimir Putin is so upset by criticism of his expansionist policies, beginning with his takeover of Crimea in southern Ukraine and support for pro-Russian elements in eastern Ukraine, that he will oppose any moves led by western countries, notably the United States, to bring North Korea to justice. Russia, moreover, sees North Korea as a battleground state that it would like to play against China as well as the U.S. and the west.

Besides all that, Russia is courting the North Korea for deals on natural gas while pressing ahead with plans to build up commerce across its brief Tumen River border with the North to the nearby Rason economic zone and, some day, down to South Korea.

The question critics then ask is why should the United States and its allies pursue the human rights issue? Critics say this policy is only inflaming tensions.

Extremists believe such criticism heightens the danger of a second Korean War in which the North, driven like the proverbial rat in a corner, fights for its life with nuclear weapons.

You hear this view expressed in debates on North Korean human rights in the U.S. Congress and also in debates on a bill condemning North Korean human rights that has languished in South Korea's national assembly.

These objections are absurd. If the U.S. and South Korea were to heed such nonsense, the lesson would be obvious. All North Korea has to do is conduct an intensified propaganda campaign in order to frighten its enemies into backing down. The point is not only to stand firm but to call North Korea's bluff, to make clear the rhetoric is useless, has no impact and accomplishes nothing.

Yet another factor enters the argument here. What of the millions suffering under North Korean rule? What of the torture and fears endured by hundreds of thousands caught up for life in the worst prison camps and millions more who have to live in terrible poverty with not enough to eat and no access to medicine and other vital supplies?

Should we forget about them as well while cowering under the fear that North Korea's leaders are attempting to spread among their critics.

The real shock of this discussion is that some people in both the U.S. and South Korea, and elsewhere should have been taken in by North Korea's propaganda blitz. Many of these people see themselves as liberals, anxious to protect the rights of poor people everywhere, quick to criticize their governments as conservative and insensitive.

Why would they battle for the rights of workers, for higher wages for laborers, for restraints on the power of tycoons but show such total lack of sensitivity for the vast majority of North Koreans eking out their living on starvation wages while their leaders live in comfort and luxury?

The international community has a sacred duty to fight for human rights for North Koreans. In the face of left-wing criticism, the United States and other western countries seem committed to the need for bringing North Korea to trial. Although the chances of achieving this goal are almost nil, they at least have to fight for what they believe.

And yet, another possibility looms. After China and Russia have blocked the North Korean case from reaching the International Criminal Court, it's quite possible that the U.S. and others will tire of their crusade for human rights in North Korea and consider North Korea's proposals for resuming talks that will only legitimize the North's nuclear program.

The international community, led by the U.S., has to make sure North Korea fails totally in it propaganda blitz even if the case of North Korea's human rights abuses never goes to trial.
