연방 상하원 장악한 공화당, 레임덕의 오바마 대통령과 사사건건 대립

백악관과 의회 사이에 단절의 골이 깊어 미국에서 민주주의가 망가졌거나 제대로 작동하지 않는 것처럼 보인다. 연방 상하원을 장악한 공화당은 민주당의 버락 오바마 대통령이 남은 2년 미만의 임기 중에 추진하려는 중요 법안들을 막겠다는 의지가 강하다.

의회에서 공화당과 민주당 간의 협력 거부는 한국 국회에서 보수우파 의원들과 진보좌파 의원들이 협력을 거부하는 것만큼이나 분열되어 있고 위험하다. 오바마 대통령은 수백만 명의 미국 노인들에게 중요한 국민연금과 건강보험(medicare)을 갉아내려는 공화당의 움직임에 맞서면서 자신의 의제들을 관철시키기 위해 남은 임기 동안 싸울 것이다.

동시에 오바마 행정부는 대기업들에게 과중한 부담이 되고 있는 규제들을 제거하기 위해 공화당과 협력을 해야 한다.

공화당은 기본적으로 1930년대 프랭클린 D 루즈벨트 대통령의 뉴딜(New Deal)정책에서 시작되어 해리 투르먼 대통령의 공정 정책(Fair Deal)과 린든 존슨 대통령의 위대한 사회(Great Society) 정책으로 고착이 된 진보적 개혁들을 뒤엎기를 바라고 있다.

오바마 대통령의 고군분투

오바마 대통령과 의회의 관계에서 최고의 역설은 태평양 연안의 최소 12개 국가들과의 교역 관계를 바꾸는 환태평양경제동반자협정(TPP)을 채택하기 위해 오바마 대통령에게 필요한 신속 처리 권한(fast-track authority)이 의회에서 승인되도록 공화당이 협력하고 있다는 것이다.

미국 노조들은 이 광범위한 자유무역협정이 체결되면 기업들은 동남아에서 저렴한 노동력을 확보해 이윤을 보겠지만 미국 노동자들은 일자리를 잃게 될 것이라고 많은 민주당 의원들을 설득해 놓았다.

신속 처리 권한을 승인받으려는 오바마 대통령의 첫 번째 시도가 실패한 후  지금 의회에서는 두 개의 법안이 채택될 전망이다.

첫째는 의회가 특정 조건을 고집하거나 끝없는 토론에 빠지지 않고 대통령이 타결한 거래를 승인 혹은 불승인만 하도록 하는 것이고, 둘째는 공장이 해외에 세워져 일자리를 잃게 되는 미국 노동자들을 위한 재훈련, 재교육 프로그램을 마련하는 것이다.

오바마 대통령은 자신의 임기 중 최대 업적인 오바마 케어로 불리는 건강보험개혁법(ACA)을 위해 싸워왔다. 공화당은 이 법안을 폐기시키지 못하더라도 약화시키기 위해 많은 노력을 기울였다.

하지만 연방 대법원은 이 법에 따라 건강보험을 구입한 사람들에게 지급되는 연방 보조금이 합헌이라고 판결하면서 이 법을 반대하는 사람들에게 패배를 안겼다.

이 법은 완벽하진 않지만 이 법이 없었다면 건강보험을 갖지 못했을 수백만 명의 미국인들이 자신들의 소득으로 감당할 만한 저렴한 건강보험을 갖도록 했다. 미국은 세계 최고의 의사, 병원, 가장 혁신적인 의료연구시설을 갖고 있지만 정작 미국인들은 세계에서 가장 비싼 의료비로 어려움 가운데 있다. 오바마 케어는 이런 불평등을 바로잡기 위한 한 방법이다.

오바마 대통령은 오바마 케어와 TPP를 위해 싸우면서 동시에 교육개혁법안, 개선이 필요한 도로망과 철도 시스템, 국토안보 및 다른 프로그램들에 대한 법안 등 끊임없는 어려움에 봉착해 있다. 공화당은 이것들은 비용이 너무 많이 들기 때문에 균형재정을 위해 축소하는 것이 필요하다고 말한다.

힘들고 어려운 게 민주주의

하지만 공화당은 수많은 적들로부터 미국을 보호해야 한다는 생각에 국방 예산을 늘려야 한다는 입장이다. 공화당이 의회를 장악하고 있는 한 오바마 대통령은 총기규제 법안 마련은 시도도 못할 것이다. 의회는 미국 내 1200만 명의 ‘불법 체류자’ 중 500만 명이 미국에 합법적으로 거주할 수 있도록 하자는 이민 개혁에 동의하지 않을 것이다.

이런 상황에서 오바마 대통령이 할 수 있었던 최선은 대통령 행정명령을 발동해 법원이 한시적으로 불법 체류자들을 추방하지 못하도록 하는 것이었다.

백악관과 의회의 싸움은 연방 예산에 대한 논란에서 절정을 이뤄왔다. 의회는 전년도 예산이 종료되기 전에 새 예산안이 발효되는 것을 거부해왔다. 이런 입법부와의 전쟁 게임으로 정부 기관들은 중요한 업무들을 중단해야 했고, 그러다가 의회가 예산안 일시 연장을 타결하면 업무를 계속하는 식이었다.

채택된 예산들은 ‘상한선’을 정함에도 불구하고 미국의 재정적자를 심화시키고 있다. 과정에서 공화당은 일부 정부 프로그램들은 “일하고 싶어 하지 않는 수백만 명의 의존성을 증가시키는 공짜 선물”이라며 이 프로그램들을 삭감하는 데 혈안이다.

행정부와 입법부 간의 이 전쟁은 매우 거칠어 미국 민주주의에 문제가 있다는 인상을 주고 있다. 오바마 대통령은 이른바 레임덕으로 자신이 지지하는 프로그램들을 관철시킬 능력이 없는 것으로 평가되고 있다. 그는 정부의 운영을 위험에 빠뜨리는 예산을 두고 매년 의회와 싸워야 한다.

빈부 격차가 커지는 상황에서 의원들은 의사진행발언(filibuster)이라는 방식으로 토론을 늘리면서 자신의 특권을 남용하고 있다. 이렇다보니 미국 민주주의가 지속될 수 있을지에 대한 의구심이 커지고 있다.

Obama versus Republican Majority in U.S. Congress Tests Democracy

The disconnect between the White House and the Congress is so profound that it sometimes appears that democracy as practiced in the United States is either broken or not working. Republicans in control of both the House of Representatives and the Senate have vowed to block just about every significant piece of legislation that the Democratic president, Barack Obama, wants to see enacted before his term ends less than two years from now.

The refusal of Republicans and Democrats to work together in Congress is every bit as divisive and dangerous as that between conservative and liberal-leftist members of South Korea's national assembly. Obama will be battling to the end of his term to ram through major points in his agenda while fighting off Republican-led campaigns to gnaw into the social security and medicare programs that are so important to millions of elderly Americans.

The Obama government also has to deal with Republican  efforts to do away with regulations that big business finds onerous. Basically, Republicans want to reverse the pattern of liberal reform instituted in the 1930s in the New Deal of President Franklin Delano Roosevelt and perpetuated in the Fair Deal of Harry Truman and the Great Society of Lyndon Johnson.

A supreme irony of Obama's problems with the Congress is that the Republicans have sided with him in his bid for approval of the fast-track authority that he needs for Trans-Pacific Partnership that would transform trading relationships among at least a dozen countries on both sides of the Pacific.

American labor unions have convinced many members of the Democratic Party that American workers would lose jobs under a broad free-trade agreement while business interests would profit from cheap labor in Southeast Asian countries.

After first dealing TPP a stinging defeat, the Congress now appears likely to pass two bills. The first would give the president the authority to make deals that the Congress has to approve or disapprove without tacking on conditions or engaging in endless debate. The second provides for a program for retraining and reeducating workers who might lose their jobs as factories go overseas.

At the same time, Obama has had to fight for what is probably the greatest piece of legislation enacted in his presidency -- the Affordable Care Act known as Obamacare. Republicans have been working hard to undermine if not destroy the bill, but the Supreme Court dealt the opposition a defeat by ruling that federal subsidies for those buying insurance under the act was constitutional.

The bill is far from perfect but brings "affordable care" to millions of Americans who otherwise have no health insurance. Although the U.S. has some of the world's finest doctors, best hospitals and most innovative medical research facilities,

Americans also suffer under the world's highest medical costs -- far more than most people can afford. Obamacare represents a step toward rectifying that inequity.

While fighting for Obamacare and TPP, Obama has encountered endless obstacles on legislation for education reform, for badly needed improvements in the nation's road and rail systems, for homeland security and a host of other programs.

The Republican argument is that all these would cost too much and it's necessary to scale them down in hopes of balancing the budget. Yet the Republicans do want to increase the budget for the armed forces, at the core of their outlook on the need to defend the U.S. against a host of enemies.

As long as the Republicans control Congress, Obama cannot begin to push through legislation for controlling access to weapons. Nor is the Congress going to agree on immigration reform that would enable 5 million of the 12 million "illegals" who are already in the U.S. to stay legally. The best that he could do was to invoke executive authority that a court has blocked as usurping the powers of individual states.

The fighting between the White House and the Congress has reached fever-pitch during debates on the federal budget with Congress refusing to enact a new budget before the expiry of the previous budget. In these legislative war games, government agencies have had to stop all but the most important work while the Congress hammers out extensions and stopgap measures to keep the government going.

The budgets as enacted have vastly deepened the U.S. budget deficit despite efforts at imposing "ceilings." It is in this process that Republicans in the Congress have fought most vigorously to slash government programs that they say are giveaways that increase the dependency of millions of people who don't want to work.

Battles between the executive and legislative branches have been so hard fought as to give an impression of a breakdown of American democracy. Obama as president has often been called a lame duck for his inability to ram through the programs that he espouses. He faces an annual clash with the Congress over the budget that jeopardizes the operations of the government.

As the rich-poor gap widens, members of Congress abuse their privilege by extended debates known as filibusters. One wonders if the basic system will survive this basic test of its durability.
