[포커스] 유엔 북한인권사무소 개소 1주년 기념 심포지엄

북한의 인권유린 실태를 조사와 책임자 처벌을 위한 자료를 수집 및 보존을 목적으로 지난해 6월 23일 서울에 설치된 유엔 북한인권사무소(이하 서울사무소) 개소 1주년을 기념하는 심포지엄이 개최됐다.

지난 6월 27일 서울글로벌센터에서 열린 이번 심포지엄은 연세휴먼리버티센터(소장 이정훈)와 북한 반인도범죄철폐 국제연대(ICNK)의 공동 주최 및 민주평화통일자문회의 후원으로 이뤄졌으며, 북한인권에 대해 활발한 활동 및 연구를 전개하고 있는 각국의 저명인사들이 다수 참여했다.

행사는 1, 2부로 나뉘어 진행되었으며, 1부 행사는 북한의 반인도 범죄 책임자 규명 방안 및 정의 실현을 위한 국제 메커니즘에 대해 논의하는 토론의 장으로 마련되었다.

이정훈 인권대사의 환영사로 시작된 1부 순서는 송상현 전(前) 국제형사재판소(ICC) 소장의 기조연설, 시나 폴슨 유엔 북한인권 서울사무소 대표, 최석영 전 제네바 대사, 제성호 중앙대 교수, 고영환 국가안보전략연구원 부원장 등 국제적인 북한인권 활동가와 학자들의 토론으로 진행되었다.

토론은 북한 당국의 반인도 범죄의 책임자에 대한 규정, 책임자에 대한 책임 규명 및 처벌, 정의 실현을 위한 국제 메커니즘의 활용 방안에 대한 의견 제시 및 논의가 활발하게 펼쳐졌다.

시나 폴슨 소장은 북한의 인권 유린 범죄 주체에 대한 연구와 감시를 대한민국 정부를 비롯한 다수의 기구들과 협력해야 할 필요성이 있다고 강조했다. 최석영 전 대사는 탈북자들이 경유하는 중국과 동남아 국가들에 대한 모니터링 등의 압박을 가할 필요성을 역설했고, 고영환 부원장은 북한의 반(反)인도범죄 책임자를 김정은에 초점을 두고 국제 여론을 확산해야 할 필요성에 대해 이야기했다.

2부는 북한인권 문제 해결을 위해 앞장서서 노력하고 있는 국제 인사들로 구성된 ‘북한인권 현인그룹’(The Sages Group on North Korean Human Rights) 창립행사로 마련되었다.

현인그룹은 이정훈 인권대사, 마르주키 다루스만 유엔 북한인권 특별보고관, 마이클 커비 전 유엔 북한인권조사위원회(COI) 위원장, 소냐 비세르코 전 COI 위원, 송상현 전 국제형사재판소 소장 등 유엔 및 정부기관, COI 등에서 활동한 멤버들을 주축으로 구성되었다.

현인그룹은 앞으로 국제적 관심사로 부각시키기 위해 다양한 활동을 벌인다. 가장 큰 활동으로는 매년 두 세 차례 서울과 뉴욕, 제네바 등지에서 북한인권 개선을 위한 전략회의를 개최하고 그 결과를 종합해 유엔과 주요국에 권고할 계획을 갖고 있다.

한편, 박근혜 대통령은 현인그룹의 출범 다음 날인 6월 28일 청와대에서 현인그룹을 접견했다. 박 대통령은 현인그룹이 북한인권 문제 해결을 위해 대한민국 정부 및 국제사회와 함께 협력하여 시너지 효과를 낼 수 있도록 힘써줄 것을 당부하며, 현인그룹에 대한 관심을 나타냈다.

제성호 : 북한 내 정치범수용소에서 행해지는 개별적 반인도범죄에 대해서는 당해 범죄를 직접 저지른 당사자(하급기관)에 대한 책임 추궁이 가능함은 말할 것도 없고, 상급자 책임론이나 지휘․명령책임론, 당․국가 차원의 정책결정 및 지시, 반인도범죄 묵인 혹은 그에 대한 감독소홀 등의 법리에 근거하여 해당 정치범수용소장, 국가안전보위부 제3국장(정치범수용소 관할)과 국가안전보위부장, 그리고 김정은 노동당 위원장 모두에게 책임을 추궁할 수 있다. 탈북자 강제북송이나 식량 배급 차별에 관한 범죄의 경우 현장에서 그와 같은 행위에 직접 연루된 자들 모두는 물론이고 그와 같은 정책을 입안․결정․지시한 자들에게도 책임을 추궁할 수 있을 것이다.

고영환 : 우리는 북한 인권문제의 초점을 김정은 책임설에 두어야 한다. 김정은에게 책임을 묻는다고 할 경우 이는 북한지도부, 북한외교당국의 첫째가는 관심사항으로 될 것이며 김정은에 대한 국제사회의 공격을 피하거나 공격의 예봉을 돌리기 위하여 일반주민들의 인권상황을 개선하려 노력하려 할 가능성이 매우 높다. 따라서 우리는 북한 인권유린의 총책임자는 김정은 자신이며 김정은을 국제사법재판에 회부해야 하고 당연이 받아야 할 처벌을 가해야 한다는 목소리를 높일 필요가 있다.

조충희 : 북한의 인권침해는 개인의 존엄성 및 자유권, 이주 및 주거권, 생명권, 피의자의 권리와 구금자의 권리, 생존권, 노동권, 정치참여권, 건강권, 교육권, 결혼과 가정에 대한 권리, 재생산권, 신념 및 표현의 권리, 집회 및 결사권, 등에 있어서 거의 보장되지 않고 있다. 이러한 엄중한 실태에 대하여 북한 인권침해의 주범들인 북한정책결정과 집행에서 책임 있는 권력실세들에 대한 국제사회의 단호한 심판이 가해져야 한다.

Signe Poulsen : the commission of inquiry stated that “Urgent accountability measures should be combined with a reinforced human rights dialogue, the promotion of incremental change through more people-to-people contact and an inter-Korean agenda for reconciliation” (COI Summary Report, paragraph 87). Broader accountability measures should take into account lessons learnt from other such processes. This includes adherence to international law, and tailored to the specific national context, thus addressing root causes of the violations. They must be victim-centred and pay particular attention to groups that risk being marginalized in the process, including women and children. The role of civil society in these processes is critical to their success.

최석영 : In a situation of united Korea, establishing a Korean national court would serve as one of the most viable accountability mechanism since the victims as well as perpetrators are north Korean residents and the Korean judiciary well qualified is best suited to conduct criminal proceedings upon crimes committed within the Korean peninsula. Of course, a number of legal and administrative questions need to be addressed in the establishment and operation of such court. The issues surrounding the establishment of transitional justice process could be looked into in parallel with or as complementary to the establishment and operation of the court, taking into account the need to ensure justice and accountability to perpetrators as well as secure the reconciliation of the Korean society for the integration process. 

Christine Chung : Obviously, there needs to be more rigorous analysis of the historical and contemporary examples beyond my sketches here and a more robust consideration of implications for North Korea. Still, we should be asking, should Kim Jong-un and the top 100 or so North Korean party officials be looking back at Russia or Germany for an indication of how things might go for them if circumstances change?  Or should they be watching more closely the current proceedings in Dakar? Personally, I would hedge my bets.

David Hawk : Nonetheless, if there are 9 votes on procedure to be had at the Security Council, it seems very worthwhile to keep the NK human rights situation in the DPRK up for discussion annually. And if the support for the ICC referral in the General Assembly resolution can be held at roughly 115 to 120 votes (let alone possibly grow), it would seem very important to continue to re-iterate the recognition of NK’s ongoing crimes against humanity. It would seem very important to hold the line on human rights concerns, and see what develops over the near term. And not let the renewed and worsened security issues re DPRK push human rights to the back burner. Perhaps oddly, it seems that NK is in a mood to talk, except it seems about denuclearization. Perhaps efforts can continue to seek various dialogues on human rights issues.
