U.S. Dilemma: How to Regulate Cryptocurrency, Stop Scamming but Let it Function Independently

암호화폐 현상이 글로벌 통화 제도를 바꾸는 길로 접어들고 있다. 그런 일은 당장이나, 내년이나, 또는 가까운 미래에 일어날 수 있는 일은 아니지만, 암호화폐는 현재보다 훨씬 더 커 질 것이다.

단순히 한 제품을 다른 제품과 교환하는 것이 아니라 몇 천 년전 제품을 사고 파는 방법으로서 귀금속으로 만든 동전의 출현과 비교할 수 있을 것이다. 또는 아마도 암호화폐의 거대함을 이해하는 데 동전 대신 지폐나 수표에 의해 오가는 계좌의 출현을 생각해보라.

이제 인터넷이 출현하면서 암호화폐는 결제, 사고팔기, 심지어 저축의 매개체로 쉽게 이용되기 때문에 우리 모두가 그것에 참여하지 않는지 묻고 싶어진다. 대답은 속이거나, 사기를 치거나, 저축을 절도하고, 대규모로 사기 치는 것이 너무 쉽다는 것이다. 이 단계에서 암호화폐는 단지 그들이 무엇을 하는지 알고 있는 사람들을 위한 것이지, 우리 나머지를 위한 것은 절대 아니다.

미 연방무역위원회는 대부분의 사람들이 암호화폐에 관해 잘 몰라 사기를 당하는 가능성을 제시하고 있다. 공정거래위원회는 “암호화폐로 결제하는 것은 신용카드나 다른 전통적인 결제 방법과 다르다는 것을 알아야 한다”고 경고한다.

공정위는 우선 “암호화폐 결제는 법적 보호를 받지 못한다”고 말한다. 다시 말해 “구매에 이의를 제기할 필요가 있다면 신용카드 회사는 돈을 되찾게 도울 수 있다.

엄청난 위험성을 고려하면 암호화폐 규제 논란은 불가피하다. 돈과 관련된 모든 미국 기관들이 암호화폐에 관여하고 있는 것과 마찬가지로 혼란의 분위기가 조성되고 있다.

이 새로운 사업 방식을 규제하기 위해 훨씬 더 많은 중앙 집중식 감독이 필요한지, 아니면 수십억의 이익을 위해 규제를 푸는 것이 암호화폐 혁명이 성장하고 확산될 수 있을 것인지가 큰 문제이다.

현재로서는 사기를 당하지 않고 정상적으로 암호화폐를 활용하는 방법이 무엇인지 알기는 아직 이르지만 증권거래위원회의 헤스터 피어스는 마켓워치와의 인터뷰에서 “미국이 암호화폐 입법화에 뒤처져 있다”고 말했다. 그녀는 마켓워치와의 인터뷰에서 “우리는 다른 나라들이 암호화폐를 규제하는 데 더 생산적인 접근법을 취하는 것을 봐 왔다”며 “우리의 접근 방식은 반대하며 사람들에게 기다려 달라고 말한다. 우리는 이 산업에 적합한 프레임 워크를 구축해야 한다”고 말했다.

기관 간 갈등은 모두 자체적인 규칙과 규정을 적용하는 한 피할 수 없다. 당장 증권거래위원회 이외에 상품선물거래위원회, 미 재무부, 연방준비은행 등이 하나같이 암호화폐 이슈에 휘말리고 있다.

피어스는 마켓워치와의 인터뷰에서 “미 의회가 ‘가이드 라인을 정해라’ 함께 모여 ‘어디에 무엇이 저촉되는지’라는 법령을 제정할 필요가 있다”며 “그래야 기업가들이 암호화폐와 관련한 규제 정책에 대한 명확한 이해를 하게 된다”고 말했다. 그러나 증권거래위원회는 규제만 잘 이뤄진다면 암호화폐에 반대하지 않는다.

실제로 피어스는 암호화폐 시스템 분산이 사업 수단으로서의 실현 가능성을 높여줬고 이 기묘한 새로운 형태의 금융이 모든 사람에게 적용될 수 있다며 전적으로 찬성했다. 그녀는 “암호화폐를 금지하려고 하는 것은 잊어버려라”고 말했다. 그녀는 마켓워치에 이렇게 말했다. “정부에서는 허용되지 않는다고 말할 수 있지만 사람들은 여전히 그것을 할 수 있고 사람들이 그것을 하는 것을 막는 것은 매우 어려울 것이다. 바보 같은 짓이다.”

혁신과 성장, 불법 사이의 암호화폐의 다양한 가능성

립튼은 “규제 당국이 우려하는 모든 종류의 활동들이 있다”고 말했다. 그는 돈세탁, 불법적 수단과 방법을 가리지 않는 거래를 우려하며 “미국은 이 부문을 규제할 방안을 고민하고 있다”면서도 “계속 혁신하고 성장하는 데 해가 되지 않는 방향으로 고민하고 있다”고 말했다.

대규모 사이버 범죄는 지속적인 위협이 된다. 30억 달러에 가까운 비트코인이 상당 부분 바이낸스를 통해 부정 거래되고 있다는 또 다른 보도가 나오자 정부 기관들이 암호화폐 업계의 선두주자인 바이낸스를 제로화 하고 있다고 블룸버그 통신은 보도했다.

이와 같은 유형의 활동과 함께, 동유럽의 많은 운영자들이 랜섬웨어 공격으로 기업들이 사업을 할 수 없도록 만들며 주요 기업들로부터 빼앗은 거대한 계정, 기업 비밀, 메시지 트래픽을 복구하는 대가로 수백만 달러를 요구한다.

예를 들어 미국에서는 미국 동부의 연료의 반을 수송하는 콜로니얼 파이프라인이 공격받아 며칠 동안 중단되었다가 다크사이드라고 불리는 동유럽의 범죄 조직에 몸값으로 500만 달러를 지불했다고 보도되었다. 이 공격으로 인해 많은 주유소들이 문을 닫게 되었고 연료 가격이 상승했고 수백만 명의 운전자들에게 불편을 줬다.

믿을 수 없는 규모의 이러한 사기 행각은 엄청난 잠재력을 가진 인터넷 시스템에서 암호화폐의 신비로운 유통으로 가능해지는데 이 새로운 사업 방식을 사용하는 사람들에게 부를 가져다주고 암호화폐를 훌륭한 방법으로 보는 비양심적인 범죄자들은 기업이나 개인으로부터 수백만 달러를 훔치며 피해자들의 삶을 비참하게 만든다.

The phenomenon of cryptocurrency is on its way to transforming the global monetary system. That’s not going to happen right away, or next year, or any specific time in the foreseeable future, but it’s here to stay and has to get bigger. You might compare it to the advent of coins made of precious metal as the way to buy and sell products a few thousand years ago rather than simply trade one product for another. Or perhaps to understand its enormity, consider the rise of paper currency in place of coins or perhaps the advent of accounts to and from which money flows by paper checks.


Now, with the rise of the internet, cryptocurrency is so easily used as a medium of payment, of buying and selling, even of saving money, that it’s tempting to ask why all of us are not getting into it. The answer is that cheating, scamming, theft of life savings and wholesale fraud on a massive scale is simply too easy. Cryptocurrency at this stage is just for those who really know what they’re doing, definitely not for the rest of us.


The U.S. Federal Trade Commission lays out the potential for scamming in terms that should scare most people away from it. “If you’re thinking about paying with cryptocurrency,” the FTC warns, “know that it’s different from paying with a credit card or other traditional payment methods.” For one thing, says the FTC, “Cryptocurrency payments do not come with legal protection.” In other words, “If you need to dispute a purchase, your credit card company has a process to help you get your money back. Cryptocurrencies typically do not.”


And then, please remember this downside. “Cryptocurrency payments typically are not reversible,” says the FTC. “Once you pay with cryptocurrency, you can usually only get your money back if the person you said sends it back.” Before you entrust your money to anyone that way, the FTC warning goes on, “know the seller’s reputation, where the seller is located, and how to contact someone if there is a problem.”


Considering the terrific risks, controversy over regulating cryptocurrency is inevitable. Just about every U.S. agency with anything to do with money is involved in cryptocurrency, creating an atmosphere of tremendous confusion. A great question is whether much more centralized supervision is needed to regulate this new way of doing business or whether less regulation would enable the cryptocurrency revolution to grow and spread for the benefit of billions.


Right now it’s much too early to be sure what is the way to harness the use of cryptocurrency so that fair play, free of the danger of scamming, is possible, but Hester Peirce, at the Securities and Exchange Commission, told MarketWatch that she believes the U.S. “is certainly falling behind the curve” in legislating what to do about cryptocurrency. “We’ve seen other countries take a more productive approach to regulating cryptocurrency,” she said in an interview with MarketWatch. “Our approach has been to say no and tell people wait…we need to build a framework that is appropriate for this industry.”


Conflicts among agencies are unavoidable as long as they all are imposing their own rules and regulations. Right now, beside the Securities and Exchange Commission, the Commodity Futures Trading Commission, the U.S. Treasury Department and the Federal Reserve Bank are all caught up in cryptocurrency issues in one way or another. The Congress needs to enact legislation that would “draw some lines” and “urge us to come together as regulators and figure out what falls where,” Peirce told MarketWatch, so “entrepreneurs have a clear understanding of regulatory policy regarding cryptocurrency.”


The SEC, however, is definitely not against cryptocurrency if regulated properly. Indeed, Peirce made the point that decentralization of the system of cryptocurrency made it more viable as a means to do business, and she was all in favor of making sure this strange new form of finance actually works for everyone. Forget trying to ban cryptocurrency, she said. As she told MarketWatch, “A government could say it’s not allowed here, but people would still be able to do it and it would be very hard to stop people from doing it. It would be a foolish thing.”


Cryptocurrencies by now are flooding the world with numerous entities getting into the act. “It's gotten so big, it now is worth more than all of the US dollars in circulation globally,” said Eric Lipton, an investigative journalist for The New York Times, in an interview with CBS. “It's no longer even conceivable for U.S. regulators to say, we're going to ban cryptocurrency in the United States.” For that reason, he said, “the U.S. government is trying to think about ways that it's going to regulate this sector.”


But the downside risks are huge. “There's all kinds of activities that regulators are worried about,” said Lipton. Worried about money-laundering and other illegal wheeling and dealing, he said, the U.S. “is trying to think about ways that it's going to regulate this sector” but “in a way that doesn't harm their ability to continue to innovate and grow.”


Cybercrime on a massive scale is a constant menace. Bloomberg has reported that government agencies are zeroing in on Binance, the cryptocurrency industry’s leader, after another report that bitcoin worth nearly $3 billion was being traded illicitly, much of it through Binance. Along with this type of activity there’s the constant danger of ransomware attacks in which operatives, many of them in eastern Europe, demand millions in return for restoring huge accounts, corporate secrets and message traffic torn away from major companies, making it impossible to do business.


In the U.S., for instance, an attack on the Colonial Pipeline, responsible for shipping nearly half the fuel for the eastern United States, had to shut down for several days before reportedly paying $5 million in ransom to a criminal gang in eastern Europe called Dark Side. The attack forced many service stations to shut down, raising the price of fuel and inconveniencing millions of motorists. Such scamming on an unbelievable scale is made possible by the mysterious flow of cryptocurrency in an internet system that has tremendous potential both for easing commerce, bringing riches to all who use this new way of doing business, and for making life miserable for victims of unscrupulous criminals who see cryptocurrency as a great way to steal millions from corporations as well as private individuals.
