JY Lee Survives in Jail, Hoping for Reprieve, While Korea Needs Samsung as Bulwark of Economy

삼성 후계자 이재용은 가슴 찢기는 듯한 중년의 위기를 겪고 있다. 그는 ‘삼성제국’의 전설적인 회장인 아버지 이건희를 잃었음에도 불구하고 꽤 좋은 경영 실적을 거두고 있는 반면, 자신은 아버지의 외아들로 지배권을 보장받고자 하는 욕망을 기본적으로 반영한 혐의로 감옥을 들락날락했다. 그가 참아온 고통은 길게 뻗어 있는 철창에서 침착하고 심지어 무감각하게 보이며 법정에서 보인 그의 태도에도 나타나지 않았다.


현재 52세인 그는 이 제도가 한국 최대의 재벌로 자동 승계되는 것에 분명히 반대한다는 것을 깨닫고 있기 때문에 저주받은 자들의 비참함을 겪고 있다. 제국의 중심축인 삼성전자 부회장 직함을 갖고 있는 이재용 부회장은 검찰과 판사, 정치적 동지, 후원자 등에게 대립하는 듯한 내면의 정서를 표출하지 않는다. 아무런 언급도 하지 않고 분노도 보이지 않으며 자비도 요청하지 않는다. 그의 성격은 재정 비리로 두 번이나 유죄 판결을 받았지만 두 번 모두 하루 동안 수감 생활을 하기도 전에 대통령들에 의해 면죄부를 받았던 때로는 격랑에 빠졌던 그의 아버지와 확연히 다르다.


흥미롭게도, 이재용은 그의 변호사들뿐 아니라 그의 두 자매로 추정되는 가장 가까운 친척들과 친구의 조언으로, 박근혜 전 대통령과 그녀의 친구이자 측근인 최순실에게 뇌물공여 혐의 판결에 대해 항소하지 않고 있다. 이재용은 2년 전 1년의 형기를 치렀으며 2년 6개월 형기의 나머지를 치러야 한다.


존경과 극기주의는 권력 당국자들이 제단에 올린 희생양인 상황에서 그가 제시할 수 있는 최선의 대응이었는데, 문재인 대통령으로부터 법의 열성적인 수호자에 이르기까지 모두 그 제도가 재벌 체제의 절대 후계자들을 억압하는 데 잘 적용되기를 열망했다. 이재용의 경우 특히 그의 반응이 의미심장했다. 그가 승마 선수로 등극한 최순실의 딸을 위한 말 두 마리를 포함해 총 86억 원(770만 달러) 상당의 뇌물을 제공한 것은 그의 아버지가 말년을 혼수상태로 보내는 동안 삼성제국에 대한 이재용의 힘을 높일 수 있는 기업합병 승인을 얻기 위한 것이었다.

위기에 빠진 이재용이 보여준 침착함과 담담함

이재용은 고등법원이 삼성이 설치한 준법감시위원회의 말을 존중해 줄 것으로 예상했을지 모르지만 법원은 환경에 상관없이 그의 편을 들어줄 것으로 예상한 전문가 집단의 조언을 받아들이지 않았다. 법정에서 이재용은 실망한 표현을 하거나 심지어 불안한 얼굴 표정을 보여주기보다는 할 말이 없다고 판사에게 말했다. 그리고 나서 다소 놀랍게도 그의 법률팀은 그가 항소할 계획이 없다고 말했다. 그는 더 이상 지체하지 않고 교도소로 보내졌다.


이재용 부회장이 수감 생활을 하면서 가장 중요한 문제는 우선 그의 구속이 삼성의 운명에 어떤 영향을 미칠 것인가와 재벌 시스템 전체가 그 탄압으로 고통을 받을 것인가 하는 것이다. 문 대통령과 장관, 보좌관들은 1945년 일본이 항복하고 1953년 중반에 끝난 황폐화된 한국전쟁 후에 이러한 거대 기업을 설립하고 운영한 대담한 사람들의 상속자와 먼 친척들까지 풍요롭게 하는 재벌 체제에 대해 한국 생활의 불평등을 바로잡기 위해 헌신하는 개혁가로서 그들 자신을 던졌다. 이재용의 할아버지 이병철 삼성 창업주의 이름은 한국 현대사의 위인에 속하지만 진보주의자들은 아버지나 할아버지가 세운 왕국의 열쇠를 물려받은 후계자들과 경쟁 속에 자기 회사로부터 혁신과 이익을 꿈꿀 수 있는 이상을 갈망하고 있다.

삼성이 절실한 위기의 한국

그러나 이러한 고상한 이상을 위한 대가는 무엇인가? 이들 진보적 개혁가들 모두가 종종 ‘한국의 기적’을 가능케 했다는 평가를 받는 경제 엔진들을 해체하려는 비전을 가진 좌파나 사회주의자들은 아니다. 문 대통령은 산업제품의 수출 감소, 많은 가게와 상점들의 폐업 그리고 수천 명 근로자들의 해고와 해고로 이어지는 전염병의 경제적 위험에 대처하는 동안 개혁 목표의 일부에 부응하기 위해 많은 노력을 기울이지 않았다. 한국은 다른 많은 나라들보다 덜 고통 받았을지 모르지만 아직 통제하기 어려운 질병으로 인한 격변과 불안의 시기에 경제 체제를 개편하는 것을 고려하는 것은 위험하다.


위험성을 고려할 때 ‘삼성 라이징’ 의 저자인 제프리 케인은 다음과 같이 말했다. ‘애플을 이기고 기술을 정복하기 위한 한국 거인의 내막’은 “문 대통령이 2022년 퇴임 전까지 이재용을 사면할 가능성이 충분히 있다”고 본다. 케인은 “문 대통령이 재임 4년 동안 재벌개혁에 대해서는 큰 성과를 거두지 못했다”고 지적했다. “역형은 가장 강력한 재벌 총수들에게 나쁜 행동에 대한 대가를 치르게 될 것이라는 신호를 보낸다. 


하지만 그 정도는 충분치 못하다”며 케인은 “이 부회장이 감옥에 있을 때 여전히 영향력을 행사할 것”이라고 말한다. 결국 그는 “재벌 총수들은 감옥에서 회사를 운영한 전력이 있다”며 “이재용의 사무실과 먼저 상의하지 않고는 전략적인 움직임이나 대형 칩셋 주문 같은 대규모 결정을 내릴 수 없을 것”이라고 지적한다.


그러나 워싱턴에 동아시아연구센터를 설립하고 현재 회장을 맡고 있는 전직 미 공군 정보장교 출신인 타라 오 씨는 사뭇 다른 견해를 갖고 있다. 그녀는 삼성제국에 대한 장문의 연구에서  “문 정부는 삼성을 장악하는 데 관심이 있는 것으로 보인다.”, “전 세계적으로 문 정부의 조치는 5G 기술 개발의 미래뿐 아니라 중요한 생명 구조 바이오 의약품과 코로나 치료제의 글로벌 공급망을 위협하고 있다”고 기술했다.


이재용의 법적 문제는 끝나지 않았다. 수감 중 그는 여전히 별도의 주가조작 사건혐의를 받고 있지만 문 대통령이 퇴임하기 전에 그는 반드시 출소할 것이다. 한국 헌법상 문 대통령은 5년 연임할 수 없지만 내년 대선 준비선거운동 기간 동안 그를 내보내는 것이 문 대통령에게는 이익이다.


박근혜 대통령 집권 당시 혜택을 추구했던 삼성 경영진들에 대한 정치 보복으로 경제가 위태로워 한국은 삼성이 너무 필요하다. 이재용보다 더 많은 세월 동안 투옥된 박 전 대통령은 문 대통령이 그녀와 경제적 위기와 세계적 유행병 시대에 한국이 여전히 의존하고 있는 삼성제국의 후계자에게 많은 자비를 베풀기를 기도할 뿐이다.

Samsung heir Jay Y. Lee has been going through a mid-life crisis of heart-rending proportions. While the Samsung empire has been doing quite well despite the loss of its legendary chieftain, Lee Kun-hee, JY’s father, JY himself has been in and out and again in prison on charges that basically reflect his desire to insure control as his father’s only son. Somehow the torment that he has endured has not shown up in his demeanor in courtrooms, where he remains calm, composed even impassive while contemplating long stretches behind bars.


JY Lee, now 52, has every reason to be suffering the misery of the damned as he realizes the system is definitely against what might have been his automatic succession to the richest of Korea’s biggest chaebol. Lee, who holds the title of vice chairman of Samsung Electronics, the centerpiece of the empire, offers no comment, shows no anger, and asks no mercy while disguising the inner sentiments that he might be expected to harbor against the prosecutors, judges and their political allies and sponsors who all seem aligned against him. His personality clearly is totally different from that of his sometimes-stormy father, who was twice convicted for financial misdeeds but both times let off by presidents who exonerated himself before he ever had to serve a day in jail
Interestingly, JY Lee, on the advice not only of his team of lawyers but also of friends and relatives in high places, including presumably his two sisters, is not appealing his final conviction on charges of bribing the former president, Park Geun-hye, and her friend and confidante, Choi Soon-sil, Having already done a year in jail while appealing his sentence two years ago, he now faces the remainder of his sentence of two and a half years. 


Respect and stoicism were the best responses that he could offer as an example, a sacrificial lamb on the altar of the powers-that-be, from President Moon Jae-in to zealous guardians of the law, all eager to show that the system is serious about suppressing the gods of the chaebol system. In the case of JY Lee, his response was especially significant. The bribes that he was found guilty of offering, totaling 8.6 billion won, $7.7 million, including two noble horses for Choi’s equestrienne daughter, were designed to win approval for a corporate merger that would enhance JY’s power over the Samsung empire while his father was spending his final years in a coma. 


JY might have expected the high court to honor the word of a high-level compliance committee set up by Samsung, but the court was not impressed by the advice of a group of experts who might have been expected to take his side regardless of circumstances. Rather than express his disappointment, or even show by facial expression any sign of unhappiness, JY in the court said told the judge he had no comment. Then, somewhat surprisingly, his legal team said later that he did not plan to appeal. Without further ado, he was sent off to prison.


As Lee languishes in prison, the issues at stake are first how his confinement will affect the fortunes of Samsung and whether the entire chaebol system will suffer from the crackdown. President Moon and his ministers and advisers have cast themselves as reformers dedicated to rectifying the inequalities in Korean life, notably in the chaebol system that enriches the heirs and even distant relatives of the bold men who founded and ran these gargantuan corporations in the years after the Japanese surrender in 1945 and then the devastation of the Korean War that ended in mid-1953. The name of Samsung founder Lee Byung-chul, JY’s grandfather, ranks among the great men of modern Korean history, but liberals aspire to an ideal in which everyone can dream of innovating and profiting from their own companies in competition with those who have inherited the keys to their fathers’ and grandfathers’ kingdoms.
But what is the price to pay for these lofty ideals? These liberal reformers are not all leftists or socialists with visions of tearing apart the engines that are often credited with having made possible the “Korean miracle.” Moon has not done much really to live up to some of his goals of reform while having to deal with the economic hazards of a pandemic that has resulted in a decline in exports of industrial products, forced many shops and stores to shut down and resulted in layoffs and furloughs for thousands of workers. Korea may have suffered less than many other countries, but it’s dangerous to consider an overhaul in the economic system during a period of upheaval and unrest caused by a disease that’s still far from under control.


Considering the risks, Geoffrey Cain, author of “Samsung Rising: The Inside Story of the South Korean Giant That Set Out to Beat Apple and Conquer Tech,” believes “there's a reasonable chance that President Moon will pardon Jay Y. Lee before the President leaves office in 2022.”


As Cain points out, Moon “hasn't accomplished a whole lot when it comes to chaebol reform in his four years in office.” The prison sentence “signals to the most powerful chaebol leaders that they'll have a price to pay for bad behavior,” says Cain, but “isn’t that much” and Lee “will still wield influence when he's in prison.” After all, he notes, “chaebol leaders have a history of running their companies from prison” and “the executives below Jay won't be able to make a large-scale decision, like a strategic move or a big chipset order, without consulting Jay's office first.”
But Tara Oh, a retired U.S. air force intelligence officer, who founded and now serves as president of the East Asia Research Center in Washington, has quite a different view. “The Moon administration appears to be interested in taking over control of Samsung,” she wrote in a lengthy study of the Samsung empire. “Globally, the actions of the Moon administration threaten the future of 5G technology developments as well as the global supply chain for critical life-saving biopharmaceuticals and COVID-19 treatments.”


JY Lee’s legal troubles are not over. While in prison, he still faces charges in a separate case of manipulating stock market prices, but the betting is he will be out of jail before Moon steps down. Moon under the Korean constitution cannot run for a second five-year term, but in the warm-up for the presidential campaign next year it will be in Moon’s interest to let him go. Korea needs Samsung too much to jeopardize the economy for the sake of political revenge against an executive whose offense was to look for favor from the president then in power, Park Geun-hye. Overthrown and jailed for many more years than Lee, Park can only pray that Moon will bestow as much mercy on her as on the heir to the Samsung empire on which the country still depends in a time of economic malaise and global pandemic.
